Athletic Trainers, Health Professionals, May Need Extra Insurance

Attention VEA Members licensed by Board of Health Professions as ATHLETIC TRAINER, or other HEALTH PROFESSION such as nursing, dental hygiene, physical therapy, or occupational therapy. Are you athletic trainer for school students? Do you teach students or other school employees in your health profession? Contact your VEA/NEA UniServ Director by October 2, 2017 for information about adding Medical and Related Arts Endorsement to your Association Liability Insurance.

All VEA Members are covered by Association Educators Employment Liability Insurance. The EEL Insurance includes 5 EXCEPTIONS to what is otherwise an EXCLUSION for rendering, teaching, or supervising of medical, surgical, dental, nursing, or other similar services. ROUGHLY, the exceptions provide coverage for: nurse or certified health aide employed in the school clinic; PT, OT, or psychological therapy rendered by a licensed practitioner employed by schools; administration of oral medication by school employee at express request of school supervisor with advance written approval from student’s parent or guardian; emergency First Aid rendered when school nurse or other medically trained person is not readily available, and health care services rendered to special needs student at direction of school employer and with written approval from student parent or guardian.

Notice that the exceptions to the exclusion could apply to any Association Member who administers oral medication at express request of school supervisor with advance written approval from student’s parent/guarding, renders emergency First Aid when school nurse or other medically trained person is not readily available, or renders health care services to a special needs student at direction of school employer with written approval from student’s parent/guardian.

Contact your UniServ Director to review your job duties, including whether you administer oral medication or deliver health services to special needs students. We want to be sure employer direction and approval of student’s parent/guardian is properly documented for purposes of the Association EEL Insurance.

If you are a certified health aide, your work in a school clinic is covered by an exception to the exclusion for medical arts in the Educators Employment Liability Insurance.

Any Association Member who is licensed/certified as an Athletic Trainer can purchase the Medical and Related Arts Endorsement for insurance covering school employment and service as a Trainer. Training service is not covered by the basic EEL coverage because rendering medical service is excluded and the trainer may not fall within the 5 exceptions.

Any Association Member who is licensed/certified in a health profession (nursing, dental hygiene, occupational therapy, physical therapy) and TEACHES that health profession can purchase the Medical and Related Arts Endorsement for insurance covering that teaching.

Premium of thirteen dollars ($13.00) paid to VEA with Members contact information and health credentials will provide coverage from September 1, 2017 through August 31, 2018. Contact your UniServ Director immediately for information or pay the premium in time to get a full year of coverage.

Questions of insurance coverage are very fact specific and can only be made by the insurer, but your VEA Uniserv Director and the VEA Legal Service Division can provide general guidance to TRAINERS and other Health Professionals who may be eligible for additional Medical and Related Arts Endorsement.

VEA Members should also contact their UniServ Director (Click on your Local Association link for UniServ Director information) or VEA Legal Services (800-552-9554) for assistance reporting any incident in which a student was injured during your class or under your supervision. Report any death or injury requiring medical attention through VEA to the Association Educators Employment Liability Insurance. Best wishes for a great school year!
